Many owners sell before their home loan is paid off. Here is how the loan closure, buyer's payment and document release work in a Gurgaon sale.

Selling a property in Gurgaon with an outstanding home loan is entirely possible and very common. The bank holds the original documents as security, so the sale has to be coordinated so that the loan is closed and documents are released at the same time as the buyer pays. With early planning, this works smoothly.

This guide explains the steps, the documents you need from your bank and how the buyer’s payment is handled.

Still paying off your home loan?

Tell us about your property and we will explain how to sell, usually the same working day.

How it works

When you have a home loan, your bank holds the original title documents. At sale, part of the buyer’s payment goes directly to your bank to close the loan. The bank then issues a no-objection letter and releases the documents, which pass to the buyer at or after registration.

Step 1: Request a foreclosure statement

Ask your bank for a foreclosure or loan closure statement showing the exact outstanding amount, interest to date and any charges. Ask how long the figure is valid.

Step 2: Ask for a list of documents held

Request a list of original documents the bank holds. Buyers and their banks will want to know what will be released.

Step 3: Agree the payment structure

Record this in the agreement to sell.

Step 4: If the buyer also has a loan

The buyer’s bank may pay the seller’s bank directly. Both banks coordinate the release of documents and the creation of the new mortgage. Start this early, since bank processes take time.

Ask about bank letters

Step 5: Registration and document release

At registration, the loan is closed or closure is arranged, the bank provides a no-objection letter, and original documents are handed over to the buyer or their bank.

Prepayment charges

Check whether your loan has prepayment or foreclosure charges. Many floating-rate home loans to individuals do not, but confirm with your bank.

Timing

Bank letters and document release can take days or weeks. Build this into your timeline and the buyer’s expectations.

Other documents to prepare

  • Sale or conveyance deed copies
  • Occupation certificate
  • Society no-dues
  • Property tax receipts
  • Identity and PAN

Taxes

Capital gains tax may apply to the sale. Loan interest and principal benefits you have claimed may also have tax implications. Get advice from a chartered accountant.

Who this guide suits

It suits owners who want to sell before their home loan is paid off, including those upgrading to a new home.

Selling to buy another home

Many owners sell one home to buy another. Plan the sequence carefully: if you buy first, you may need bridge finance; if you sell first, you may need to rent for a while. Some banks offer loans that help bridge the gap. Discuss timing with your advisor and lender so the two transactions line up.

When the outstanding loan is larger than expected

If the outstanding loan, plus costs, is close to the sale price, check carefully whether the sale proceeds will cover everything. You may need to add funds to close the loan before documents can be released.

Keeping buyers confident

Buyers can be nervous about mortgaged properties. Sharing the foreclosure statement, the bank’s list of documents and a clear payment plan early builds confidence and keeps the deal moving.
