Builder floors need different checks from apartments. Here is what to check before buying a builder floor in Gurgaon, from plot title to floor rights.

What to check before buying a builder floor in Gurgaon differs from an apartment purchase in important ways. A builder floor is one floor of a low-rise building on a plot, usually sold with a share of the land. Floors are built by many different builders, often in plotted colonies such as the DLF phases, Sushant Lok, South City and central sectors, so documents and permissions vary widely.

This guide explains the documents and permissions to check, the floor rights to confirm and the questions to ask. Have your lawyer verify everything before you commit.

Buying a builder floor?

Tell us the floor and we will gather documents and permissions for your lawyer, usually within one working day.

Check documents

Documents to check

DocumentWhat it shows
Plot title documentsWho owns the land and the chain of ownership
Approved building planWhat the authority permitted to be built
Occupation certificateThe building is approved for occupation
Sale deed for the floorOwnership of the specific floor
Registered land shareThe floor’s undivided share of the plot
Floor rights documentationTerrace, basement, lawn and parking rights
No-dues certificatesUtilities and property tax
Builder agreementsTerms between the builder and plot owner, if relevant

Approved plan versus what was built

Compare the approved building plan with the actual building. Extra floors, enlarged balconies or structures on the terrace that are not on the plan can create compliance issues. Ask your lawyer to check.

Occupation certificate

The building should have an occupation certificate. Without one, utility connections, loans and future resale can be difficult.

Land share

Each floor usually comes with an undivided share of the land. Check that the share is stated in the sale deed and is consistent across floors.

Floor rights must be written down

Ask us to confirm terrace, basement, parking and lawn rights for each floor you like.

Confirm floor rights

Floor rights

Rights that come with specific floors must be written into the sale deed:

  • Ground floor: lawn or front or rear garden, sometimes basement
  • Top floor: terrace rights
  • Parking: allotted slots in stilt or basement
  • Common areas: stairs, lift and entrance

Builder and plot owner arrangements

Many floors are built under collaboration agreements between a plot owner and a builder. Check that the person selling has the right to sell your floor under that arrangement.

Construction quality

Inspect waterproofing, especially near bathrooms and the terrace, plumbing, wiring, the lift and the facade. Visit floors the builder completed a few years ago to see how they have aged.

Shared responsibilities

Floor owners share the lift, water tanks, common lighting and structural repairs. Ask whether there is an agreement on how costs and decisions are shared.

Home loans for builder floors

Banks lend on builder floors with clear titles and approvals. They will check the building plan, occupation certificate and land share.

The full cost of buying

  1. Agreed price on a stated carpet area
  2. Stamp duty and registration charges, which in Haryana differ for men, women and joint buyers
  3. Legal fees, any brokerage and TDS
  4. Interiors and moving costs
  5. GST if buying before completion

Questions to ask

  • Does the building match the approved plan?
  • Does the building have an occupation certificate?
  • What land share comes with this floor?
  • What rights come with this floor?
  • How are common costs shared?

Red flags

  • No occupation certificate
  • Construction beyond the approved plan
  • Unclear floor rights
  • Seller unable to show title or builder agreement
  • No agreement among floor owners on shared costs

Who this guide suits

It suits anyone buying a builder floor in Gurgaon, including first-time buyers of low-rise homes.

Buying a floor before completion

Some builder floors are sold while still under construction. This can offer a lower price, but adds risk on finish quality and timing. If you buy early, agree specifications and a completion date in writing, link payments to construction stages, visit regularly and confirm that the building will receive an occupation certificate.

Stilt parking and lifts

Most redeveloped floors have stilt parking and a lift. Check the number of slots for each floor, whether they are allotted in writing, the lift’s brand and maintenance arrangements, and how lift power backup works.

Water and power

Ask how water is stored and supplied to each floor, whether there is a borewell and how power backup is provided. Check separate meters for each floor.

Agreement among floor owners

Some buildings have a written agreement among floor owners on shared costs, repairs, parking and use of common areas. If none exists, discuss expectations with other owners before buying.
