How to Check Property Title and Ownership Before Buying a Gurgaon Apartment

Clear title means the seller has the right to sell and nothing stands in the way. Here is how title and ownership checks work for Gurgaon apartments.

Checking property title and ownership before buying a Gurgaon apartment protects you from the most serious risks in real estate: buying from someone who does not have the right to sell, or buying a property with claims, loans or disputes attached. Title checks confirm who owns the property, how they came to own it and whether anything limits the sale.

This guide explains how title and ownership checks work for apartments in Gurgaon. Title verification is a legal task, so always engage a qualified property lawyer. We help gather documents and flag questions, but we do not certify title.

Want clear title before you buy?

Tell us the apartment and we will gather title documents for your lawyer, usually within one working day.

What clear title means

Clear title means the seller is the legal owner, the chain of ownership is complete and properly documented, and there are no undisclosed loans, claims, disputes or restrictions that would affect your ownership.

Title for new projects

For new projects, title relates to the developer’s ownership of the land and the approvals to build on it. The project’s RERA page may list land title details. Your lawyer should review the land title, licences and approvals.

Title for resales

For resales, title flows from the developer’s allotment through each subsequent transfer to the current seller. Every link in this chain should be documented and, where required, registered.

Key checks

CheckWhat it confirms
Chain of documentsEvery transfer since allotment is recorded
Conveyance deedLegal transfer from the developer
Seller’s identityThe person selling is the owner on record

Ask about title

Encumbrances

An encumbrance is a claim or charge on the property, such as a mortgage. Your lawyer can check registered encumbrances. Any existing loan should be closed at or before registration, with documents released.

Joint owners and heirs

If the property is jointly owned, all owners must agree to the sale. If an owner has died, the property may have passed to legal heirs, and all heirs may need to consent or provide documents.

Power of attorney

If someone is selling under a power of attorney, check that it is registered, covers the sale, is current and has not been revoked.

Society and developer records

Ask the society and, where relevant, the developer to confirm that the seller is recorded as the owner and that there are no objections to the transfer.

Public notices

For high-value or older properties, some buyers’ lawyers publish a public notice inviting objections before completing the purchase. Ask your lawyer whether this is advisable.

Title insurance

Title insurance is not yet common in India, so careful legal checks remain the main protection.

When to check title

Check title before paying anything beyond a small, refundable token, and certainly before signing an agreement to sell.

Questions to ask the seller

  • Can I see copies of all title documents?
  • Is the conveyance deed executed in your name?
  • Is there any loan on the property?
  • Are all owners selling?
  • Are there any disputes involving the property?

Who this guide suits

It suits all buyers, especially those buying resales, older properties or from overseas.

Bank checks are not a substitute

Banks check title before lending, but their checks are for their own protection. Your own lawyer’s review is still essential.

Inherited and gifted properties

If the seller received the property by inheritance or gift, check the will, succession documents or gift deed, and confirm that mutation or society records have been updated. Missing documents can delay or block a sale.

Older properties

Older properties may have gaps in documentation from years ago. Your lawyer may need to trace records further back and confirm that earlier transfers were valid.

Mutation and records

In some cases, property records are updated in municipal or revenue records after transfer, called mutation. Check that records reflect the seller’s ownership.

Timing title checks with your loan

Your bank will run its own title check during loan processing. Share your lawyer’s findings with the bank to speed things up and resolve any issues early.

Society confirmation

A letter from the society confirming the seller as the recorded owner adds comfort for resales.
